Paid Sick Leave and Family Leave for NYS Workers Impacted by COVID-19

On March 18, 2020, Governor Cuomo signed emergency legislation guaranteeing job protection and pay for New Yorkers who have been quarantined as a result of novel coronavirus, or COVID-19. This includes paid sick leave and paid family leave for family care for workers and families in New York that have been impacted by COVID-19. We have detailed them here:

Paid Sick Leave for NY Workers

In response to the outbreak of novel coronavirus (COVID-19) in New York State, Governor Andrew M. Cuomo has guaranteed workers job protection and financial compensation in the event they, or their minor dependent child, are subject to an order of mandatory or precautionary quarantine or isolation issued by the state of New York, the Department of Health, local board of health, or any government entity duly authorized to issue such order due to COVID-19.

Most employees will get financial compensation by using a combination of benefits. These benefits are not available to employees who are able to work through remote access or other means.

As always, Paid Family Leave can also be used to care for a family member with a serious health condition.

Paid Family Leave for Family Care

COVID-19 legislation signed by Governor Cuomo enables Paid Family Leave to be used by an eligible employee if they, or their minor dependent child, are subject to an order of mandatory or precautionary quarantine or isolation issued by the state of New York, the Department of Health, local board of health, or any government entity duly authorized to issue such order due to COVID-19. This is different from Family Care. However, if you have an eligible family member who contracts COVID-19, you may be able to take Family Care to care for them, if it’s considered a serious health condition.
